Individual Bankruptcy and Consumer Law

The attorneys at our firm have represented individuals as debtors in hundreds, if not thousands, of cases under the Bankruptcy Code. Unfortunate things — such as divorce, extended illness, loss of employment or a business failure, the death of a spouse, an investment that did not succeed, or simply not being able to control spending — happen to honest people. The bankruptcy laws provide that such people are entitled to a fresh financial start.

Bankruptcy Lawyers Serving West Palm Beach

Bankruptcy involves interplay among other areas of the law such as real estate, secured transactions, state or federal exemption laws (pursuant to which certain property is protected from claims of creditors) and the like. Individual bankruptcy cases require careful consideration of a person's specific circumstances in order to make sure that their debts are forgiven. Our attorneys have both substantive knowledge of the law and experience regularly working with the bankruptcy court system and the local panel bankruptcy trustees. We make the time to apply this knowledge and experience to the specific facts of every person's case (whether the client is single, separated, divorced or married and, if so, whether only one or both spouses may need our counsel), in order to help clients make informed decisions as to what is in their best interests. We know what to do in a consumer bankruptcy case. We also know what not to do in a consumer bankruptcy case.

Regardless of the legitimacy of a person's circumstances, there are occasions when litigation is necessary in an individual bankruptcy case. At times, creditors are simply recalcitrant. Examples of these disputes are where the discharge of a specific obligation is challenged, an objection to the discharge all of a client's debt is lodged or the government takes issue with the discharge of federal income taxes.

Changes to the Bankruptcy Code in 2005 (BAPCPA) have created conflicts among courts regarding the ability to deduct certain expenses in Chapter 13 cases. We stay abreast of this emerging body of law, and thus have successfully represented clients in obtaining court approval of repayment plans.

We understand that people's lives can be affected by circumstances beyond their control such as a decline in the real estate market. Our insolvency, litigation and commercial law experience has enabled us to successfully defend residential mortgage foreclosure cases and to otherwise obtain workable solutions for clients faced with overly burdensome residential mortgage debt.

We represent people from all walks of life. Many of our clients have been (and are again) successful business people and professionals. We put the same thought, effort and passion into the work we perform for our individual clients as we do for our corporate clients. We also believe that our creditors' rights experience is beneficial to our debtor clients.

We understand that personal financial problems can be difficult to address. We invite you to make an appointment and speak with us. You will be treated with respect and compassion. We will also be forthcoming with you. Our job is to help people, not to tell them what they want to hear. We provide solutions to significant problems for people who are realistic about their circumstances and realize they need professional help. We are confident that the services we provide in this area are among the very best.
